The Labour Court placed a worker at the Dublin Institute of Advanced Studies on the Assistant Professor scale, effective from 8 February 2012, after varying a Rights Commissioner’s recommendation. The decision was signed on 18 July 2013. The worker, represented by IFUT, appealed after seeking promotion from Experimental Officer. The institute argued that upgrading him was barred by the Public Service Agreement and required ministerial approval. The court found he performed higher-grade duties, was not appropriately paid and had no fair and reasonable alternative proposal from the institute to resolve the situation.
