Labour Court rejects Kildare County Council worker’s appeal over lost allowances

The Labour Court rejected a worker’s appeal seeking compensation for lost overtime and driving allowances after his transfer to lighter duties. The decision was dated 2 July 2013. The worker estimated his annual loss at about €6,000 and argued the allowances had become established. Kildare County Council said the transfer allowed him to remain at work rather than retire on ill-health grounds, and it was not liable for losses resulting from his condition. The Court found merit in the union’s arguments but said the circumstances of the transfer did not support compensation. It rejected the appeal, leaving the Rights Commissioner’s recommendation in place.
