Labour Court grants County Cork VEC worker enhanced redundancy on appeal

The Labour Court allowed a worker’s appeal against County Cork VEC and directed payment of three weeks’ pay per year of service, in addition to statutory redundancy terms already paid. The decision was signed on 3 May 2013. The worker, represented by the Services Industrial Professional Technical Union, had been transferred from Fermoy to Mallow after the VEC said the Fermoy crèche was overstaffed. The Court found no material difference between her circumstances and those of colleagues who received enhanced terms, and no justification for treating her differently. It varied the Rights Commissioner’s recommendation, which had found the claim failed.
