The Labour Court set aside a €1,000 Rights Commissioner’s recommendation and directed Mater Misericrodiae University Hospital to pay a worker €5,000 over unpaid overtime. The decision was signed on 25 January 2013.
The worker, represented by the Irish Medical Organisation, appealed the recommendation. The hospital accepted that she had not been paid for all overtime, but said she knew about and consented to the arrangement.
The Court found that her contract entitled her to payment for all hours worked and that her approved timesheets met the contract’s overtime conditions. It also found that her delay in raising the matter deprived management of an opportunity to address it promptly and that she contributed to her own loss.
