The Labour Court amended an earlier recommendation and recommended that St Johns Hospital pay a theatre nurse €5,200 for a specialist qualification allowance. Its decision, signed on 11 March 2013, allowed the union’s appeal on the nurse’s behalf. The nurse worked in the hospital’s Day Unit and held a specialist qualification in Theatre Nursing. The union said she was entitled to the allowance when rotating through different areas of the unit. Hospital management argued that it applied only when she was doing duties related to her qualification. After considering her duties, the Court found that she met the criteria for payment. It amended the Rights Commissioner’s earlier recommendation of €2,500 to recommend payment of €5,200.
