The Labour Court dismissed Waterford City Council’s appeal and affirmed a Rights Commissioner’s recommendation that an anonymised worker’s role and salary be reviewed. The worker said she was receiving the wrong rate under a circular setting the applicable pay scale. The Council argued she did not qualify and was paid correctly for her contracted duties. The Court said there was no justifiable basis for not paying the Senior Executive Engineer rate established as appropriate in 2010. Its decision was signed on 6 March 2013.
