Labour Court upholds HSE regrading decision on worker’s appeal

By Niamh Kearney

Historic decision · Decision date:

Place: no local area assigned from the source.

The Labour Court upheld a Rights Commissioner’s recommendation that an anonymised worker’s claim for permanent regrading was not well founded. The worker, represented by the Services Industrial Professional Technical Union, said he continued to perform the duties of a higher-grade post he had previously held temporarily. The HSE said his specific-purpose contract had expired, he had returned to his permanent Stores Assistant post and his application for the vacancy was late. The Court found no reasonable basis to interfere with the Rights Commissioner’s conclusions and recommendation. The decision was signed on 6 March 2013.
