Labour Court upholds recommendation against Two Workers’ lost-overtime compensation claim

The Labour Court upheld a Rights Commissioner’s recommendation not to concede Two Workers’ claim for compensation for lost overtime. The decision was signed on 4 March 2013. The Irish Municipal, Public and Civil Trade Union, representing the workers, said the overtime had been regular and rostered. Dublin City Council said it was voluntary, pooled and linked to sporting and cultural events. The Court found that the weeks worked and earnings fluctuated, and that the overtime was not regular, rostered or compulsory on a sustained basis.
