The Labour Court disallowed a worker’s appeal and affirmed the Rights Commissioner’s recommendation against his claim over continuity of employment. The decision was dated 16 November 2012. The worker said his employment remained continuous while he undertook private studies and that the break affected his chance to apply for a permanent rostered position. HSE West said his employment ended during his studies. The Court said HSE West and SIPTU had agreed that the 2004 cessation broke continuity, and it would not interpret their agreement differently.
