The Labour Court overturned a recommendation that a worker’s tool-allowance claim should fail and recommended that South Tipperary County Council pay the allowance on the same basis as before. The decision was dated 13 November 2012. The worker, represented by the Services Industrial Professional Technical Union, argued that the previous holder of the position had received the allowance. The council said the worker was not a qualified craftworker and that the allowance was limited to specific craftworker posts. The Court relied on an earlier recommendation that the vacancy be filled on the same basis as before.
