Labour Court rejects worker’s appeal over PRSI deductions

The Labour Court disallowed a worker’s appeal and affirmed the Rights Commissioner’s recommendation that his claim for a refund of PRSI deductions fail. The decision was signed on 12 September 2012. The worker, represented by the Services Industrial Professional Technical Union, said Securtias Security Services Ltd had deducted too much PRSI and should reimburse him. The company said it made the deductions in good faith based on information he supplied and had tried to secure a refund. The Court said both sides had been genuinely mistaken about the correct rate over many years. It said it could not hold the employer liable for the overpayments in light of the four-year limit on recovery.
