The Labour Court disallowed a worker’s appeal and affirmed the Rights Commissioner’s recommendation that her claim about the pro-rata calculation of her hourly rate fail. The decision was signed on 3 September 2012. The worker stopped pursuing her claim for increments at the hearing; that claim was withdrawn. The worker, a part-time Accounts Administrator represented by the Services Industrial Professional Technical Union, said her hourly rate was incorrectly calculated. Fingal Leader Partnership Co. Ltd said it used an established method to calculate her pay. The Court found that her salary was correctly calculated by dividing the full-time salary by 39 hours and multiplying the result by her 27.5-hour week. Both figures included meal breaks.
