The Labour Court rejected a worker’s appeal over his demotion from night supervisor to tool setter at G Bruss GmbH, upholding the Rights Commissioner’s recommendation. The decision was signed on 9 July 2012. The worker, represented by the Services Industrial Professional Technical Union, argued that the investigation was unfair and that he had suffered financial loss. G Bruss GmbH, represented by the Irish Business and Employers’ Confederation, said it had investigated the allegations and that his conduct made his supervisor role untenable. The Court found that, as the person solely in charge at night, he had responsibility for running the plant and contributed to a difficult situation on 24 February 2010. It considered the demotion a reasonable sanction.
