Labour Court varies HSE West appeal over Two Workers’ acting-up allowance

The Labour Court varied a Rights Commissioner recommendation after HSE West appealed a dispute over Two Workers’ pay grading. The workers, represented by the Services Industrial Professional Technical Union, said they performed Instructor work while paid as Multi Task Attendants. HSE West argued they had not been appointed as Instructors and that public-sector restrictions barred the claim. The Court found they were doing Instructor work and said it was unreasonable to expect this without commensurate pay. It varied the recommendation to provide an appropriate acting-up allowance from 3 February 2012, when the original recommendation was issued. The appeal failed. The decision was dated 9 July 2012.
