The Labour Court overturned a Rights Commissioner’s rejection of a worker’s claim over Sunday shifts and recommended €6,318.50 compensation from HSE West – St John’s Hospital. Its decision was dated 9 July 2012. The worker had been rostered for Sunday work until December 2005, when he reduced his hours for personal reasons and management stopped rostering him as part of an equalisation process. The employer said he had no contractual entitlement to Sunday night work and that shifts were distributed fairly. The Court found that equal distribution should have included him and recommended that the payment be made within six weeks.
