The Labour Court upheld a recommendation that City of Limerick VEC pay a worker enhanced redundancy terms of two weeks’ pay per year of service, on a without-precedent basis. The decision was dated 21 June 2012. The worker, represented by the Irish Municipal, Public and Civil Trade Union, said she thought the waiver she signed confirmed receipt of her redundancy payment. The VEC argued she had accepted statutory redundancy and had been advised to consider the waiver. The Court found the waiver did not settle the claim because the worker received no consideration beyond her statutory entitlement. It also found the way the waiver was presented did not meet the Court’s tests for such documents.
