The Labour Court affirmed a recommendation placing a worker on the Team Leader Social Worker salary scale from 1 June 2011 and paying her €1,000 compensation. The decision was dated 14 May 2012. Represented by the Services Industrial Professional Technical Union, she sought an upgrade and said she did more work for less pay. HSE West argued the claim was barred by the Public Service Agreement and promotion moratorium. The Court classified the claim as one for the appropriate rate for the job, rather than an increase in the existing rate, and said it was not precluded by the agreement. It nevertheless found the Rights Commissioner's conclusions reasonable and dismissed the worker's appeal.
