The Labour Court rejected a worker's appeal and upheld the Rights Commissioner's recommendation after finding HSE-South-East had not breached the Job-Sharing Scheme. The decision was dated 10 May 2012. The worker, represented by the Irish Municipal, Public and Civil Trade Union, sought to return to full-time work after job-sharing. HSE-South-East said no suitable vacancy existed at her current location, St Dympna's Hospital, Carlow, and offered a temporary position in Kilkenny, which she declined. At the hearing, she was open to considering other positions at her grade in the wider region, and HSE-South-East was willing to notify her of vacancies.
