Labour Court changes HSE West recommendation on worker's job options

The Labour Court varied a recommendation on a worker's appeal, requiring HSE West to tell him about vacancies for which he qualified and give him a full opportunity to apply. The decision was dated 23 April 2012. The worker, represented by Barron Moohan O'Donnell Solicitors, said HSE West had refused to appoint him to a suitable position and breached his employment contract. HSE West said it had acted in line with his contract and the Public Service Agreement, which required staff to cooperate with reasonable changes. The Court said the original recommendation should be amended to address his concern about opportunities to apply for alternative posts suited to his skills and training.
