The Labour Court rejected a worker’s appeal and upheld a recommendation that he be considered for suitable level 2 jobs as they became available. The decision was signed on 16 January 2012. Coillte Teoranta had created a Farm Partnership Manager post in 2005, but did not advertise it and appointed another employee at level 2. The worker, represented by the Irish Municipal, Public and Civil Trade Union, said he had been centrally involved in the work and believed he was the obvious choice. Coillte said he could have used its grievance procedure and that efforts to resolve the dispute had failed.
