Labour Court sets aside €10,000 recommendation to worker on HSE appeal

The Labour Court allowed the Health Service Executive’s appeal and set aside a €10,000 recommendation to a worker. Its decision was dated 27 March 2012. The worker had sought regularisation of a long-term acting Grade VIII post and retrospective incremental credit. The Rights Commissioner had recommended a review of her lump sum and pension rights and a €10,000 compensatory payment. The Court said the worker knew she held an acting Grade VIII post and had sought to have it regularised. It said workers who take voluntary early retirement normally accept enhanced terms in full and final settlement of outstanding industrial relations claims, and saw no reason to depart from that practice in this case.
