The Labour Court upheld a recommendation that Tesco Ireland Limited compensate a worker for earnings lost after restructuring at its Castlebar store. Tesco’s appeal failed. The decision was dated 21 March 2012. The worker’s Section Manager role was replaced by a Line Manager role requiring an application. He did not apply and was placed in a lower-paid Team Leader role. Tesco argued he had chosen not to apply and was not entitled to compensation. The Court found he had little choice but to take the Team Leader role and upheld the recommendation for compensation of one and a half times his annual earnings loss.
