The Labour Court upheld Dublin City Council’s appeal and overturned a Rights Commissioner’s recommendation for acting-up increments. The decision was dated 4 February 2010. The worker’s appeal for permanent appointment also failed. The Council said government circulars governed the worker’s pay and that it had applied them, moving him to point six and paying more than €7,000 in arrears. The Court found the Council had applied the circulars correctly and had no discretion to grant further incremental credit. The Council planned a competition to fill the post permanently.
