The Labour Court rejected a worker’s appeal and upheld a Rights Commissioner’s recommendation that Henry Denny & Sons (Ireland) Limited pay him €1,000 as an ex-gratia lump sum in full and final settlement. The decision was dated 17 October 2011. The worker said he should have been recalled for temporary work after his employment ended in May 2006 and should have received redundancy payments. SIPTU said less-senior employees had been rehired, while the company said it chose temporary staff according to suitability and availability. The Court noted that work had diminished considerably between May and December 2006.
