The Labour Court said Kildare County Council should consider a Senior Executive Engineer's future application to its Shorter Working Year Scheme on its merits. The decision was signed on 27 September 2011. The Union appealed after the Council refused his 2010 application for unpaid leave. The Council said it had refused all applications made at the same time for organisational reasons. The Court found the Council had effectively ceased operating the scheme and saw no justifiable reason it should not operate it. It said the Council and unions should negotiate any modifications needed to address staffing issues.
