Labour Court rejects HSE worker's night-shift penalisation claim

The Labour Court found that a worker's penalisation claim against HSE was not well-founded and upheld the Rights Commissioner's finding. The decision was signed on 26 September 2011. The worker said her removal from night work at Wexford General Hospital was retaliation for a complaint made on her behalf to the Health and Safety Authority. HSE said the revised roster followed a health and safety assessment and that the worker chose day shifts. The Court found the roster changes were related to the assessment, which it considered necessary, although it was not fully satisfied that her workload concerns had been adequately addressed. It recommended that future complaints about excessive workloads include representation on behalf of the complainant.
