Labour Court overturns rejection of Comans Wholesale worker’s bullying complaint

The Labour Court allowed a worker’s appeal and awarded her €2,500 compensation after finding Comans Wholesale Limited failed to follow up on her bullying complaint. The decision was signed on 27 January 2011. The worker said she raised concerns about her line manager with the financial controller, but the employer did not report back or monitor the situation. Comans Wholesale Limited did not attend the hearing. On the worker’s uncontradicted evidence, the Court found the employer’s failure to follow up and take steps to prevent the behaviour recurring was a fundamental flaw. It set aside the Rights Commissioner’s recommendation, which had found the complaint not well founded.
