The Labour Court upheld Waterford City Council’s appeal and overturned a Rights Commissioner recommendation on an unnamed worker’s pay, in a decision dated 30 June 2011. The Court said the worker should not retain the Traffic Warden grade after moving to a General Operative role. It recommended that the Council seek to appoint him permanently to the grade he was acting up in and check whether his pay reflected that role, paying any retrospection due within four weeks. The Services Industrial Professional Technical Union had argued that his transfer followed assaults at work and that another employee in similar circumstances had kept their pay. The Council said there was no comparable grade and that retaining the higher rate could affect its pay structure.
