The Labour Court varied a €750 Rights Commissioner recommendation, recommending that South Tipperary County Council pay a worker €7,500 and restore his full sick pay from 1 July 2011. The decision was dated 9 May 2011. The dispute concerned the Council’s investigation of the worker’s complaint against his supervisor. The Court found deficiencies in how the Council handled the grievance and said it should have managed the investigation to an appropriate conclusion. It also found the worker partly responsible for provoking the incident. The Council said it had tried to resolve a heated exchange; the Services Industrial Professional Technical Union argued that the investigation was untimely and not impartial.
