The Labour Court increased compensation to €5,000 for an unnamed Proctor & Gamble/ (Manufacturing) Limited worker who lost unusually high overtime earnings after changes to overtime allocation. The decision was dated 9 May 2011. The worker appealed the Rights Commissioner’s earlier €3,000 recommendation. The union argued that the overtime was regular and rostered and the changes caused considerable lost earnings. The company said overtime was discretionary and it had exhausted its internal grievance procedures. The Court found that the worker lost unusually high overtime earnings because of restructuring and a revised allocation system. It said the overtime was neither regular and rostered nor a condition of employment, but that the worker was uniquely disadvantaged among those still employed. It increased compensation from €3,000 to €5,000 in full and final settlement, payable within six weeks.
