Labour Court rejects Boxmore appeal over worker’s final warning

Labour Court ·

The Labour Court rejected Boxmore Plastics’ appeal concerning a worker’s final written warning after a labelling error led to substandard product being sent to a customer. Its decision was dated 3 May 2011. The Court found that the company technically breached its disciplinary procedure, which provided for escalating warnings except in cases of gross misconduct. The warning had expired, so changing it would have no practical effect. The Court accepted the company’s concern about the seriousness of negligence involving product quality and recommended immediate discussions to revise the procedure, along with written notice to staff about how such conduct would be treated in the meantime.
