Labour Court sets timetable for HSE West to assess worker’s regrading claim

The Labour Court directed HSE West to identify a process to assess an anonymised worker’s regrading claim within four weeks and complete the assessment within a further eight weeks. Its decision was dated 24 March 2011. The worker, represented by the Irish Municipal, Public and Civil Trade Union, had been told he was outside the job-grading scheme and had no alternative route to pursue the claim. HSE West said it could not concede the claim because of financial constraints, HSE circulars and fairness to other staff seeking upgrades. If HSE West fails to follow the timetable and process, the Court will uphold the Rights Commissioner’s recommendation and reject the appeal.
