The Labour Court allowed Galway County Council’s appeal and replaced a recommendation that a firefighter receive sub station officer pay and benefits with €3,000 compensation. The decision was signed on 26 October 2010. The worker, represented by the Services Industrial Professional Technical Union, had missed a promotion competition while on sick leave. The Court found the Council should have asked when he could attend an interview, but said he should have sought a deferral and waited eight months to complain, after posts had been offered to others. It found fault on both sides and varied the recommendation to €3,000 in full and final settlement.
