Labour Court affirms €7,000 recommendation to senior house officer

The Labour Court affirmed a €7,000 recommendation to a senior house officer after his appeal over losses following dismissal and reinstatement. The decision was dated 4 March 2010. The Rights Commissioner’s recommendation excluded a separate complaint under the Protection of Employees (Fixed Term Work) Act, 2003. The worker said the recommendation did not resolve concerns about his rotational clause and access to training, or adequately compensate his financial and personal losses. HSE West said he had been paid all amounts owed and that his roster and job terms matched those of colleagues. The Labour Court found the Rights Commissioner’s conclusions reasonable and saw no basis to interfere. It recommended further discussions on outstanding contractual arrangements and affirmed the recommendation with that qualification.
