The Labour Court set aside two Rights Commissioner recommendations and awarded €4,500 to each of Two Workers after finding they had been treated unfairly. The decision was signed on 9 November 2009. Deepclean Hygiene Solutions Limited had said the dismissals were because the workers were ineligible for work permits; SIPTU argued that union membership was the real reason.
The Court found that the employer had not told the workers or SIPTU about difficulties obtaining permits or warned them their jobs were at risk. It also found Mr Z’s dismissal for alleged misconduct lacked procedural fairness. The Court set aside both recommendations and awarded €4,500 compensation to each worker for the unfair treatment.
