The Labour Court increased an unnamed worker’s pay award against Ballygowan Developments Ltd from €1,815.39 to €3,325. It signed its decision on 8 October 2009. The worker, a former Health and Safety Officer, said the company had failed to honour the pay terms in his contract. Ballygowan argued he was not covered by the Construction Industry Registered Employment Agreement and that the clause referring to it had been inserted in error. The Court said it had to apply the contract as written, including its clause that the agreement’s terms would be observed. It calculated increases of €900, €765 and €1,660, totalling €3,325, and made no further punitive award.
