The Labour Court upheld a €2,632.35 recommendation for an unnamed worker’s unpaid staggered-break allowance at Castolin Eutectic Ireland Limited. The decision was signed on 15 June 2009. The worker, represented by the Services Industrial Professional Technical Union, said he was owed a further ten months of allowance after receiving two months’ payment. The company said it usually paid the allowance after probation or when workers were required to work staggered breaks. Noting a signed agreement, the Court upheld the Rights Commissioner’s recommendation in this individual case and said it should not be treated as a precedent.
