The Labour Court disallowed the union’s appeal on behalf of a worker and affirmed a Rights Commissioner’s €3,000 recommendation against The Lisheen Mine. The worker was represented by the Services Industrial Professional Technical Union (SIPTU) and had been dismissed during probation from a one-year fixed-term contract. The Rights Commissioner found that the worker was not allowed to be represented or heard at the dismissal meeting and was not given written reasons, information about an appeal mechanism or prior written warnings. The company said the worker’s performance was unsatisfactory and below its standards. The Labour Court found the Rights Commissioner’s conclusions and recommendation balanced and reasonable. It affirmed the recommendation and disallowed the appeal on 25 May 2009.
