The Labour Court upheld a Rights Commissioner’s recommendation rejecting a worker’s claim that Dublin City Council breached an agreement by failing to appoint him to a Senior Engineer vacancy. The Court found there had been no vacancy in May 2007 and the Council had honoured the agreement. The worker had argued that the agreement required the Council to maintain 19 Senior Engineer posts and that he was next in line for an appointment. Dublin City Council said there was no vacancy to fill. The decision was signed on 26 May 2009.
