The Labour Court overturned a Rights Commissioner’s recommendation that Wicklow County Council place a worker on a higher incremental point and provide retrospective pay and compensation. The decision was signed on 15 January 2009. The worker, represented by the Irish Municipal, Public and Civil Trade Union, had argued that a colleague with shorter service was placed one point higher on the Grade IV scale after Circular EL 9/01 was applied. The Council said incremental credit had been applied in line with its agreements with the union. The Court found the circular’s criteria had been correctly applied to the worker. It acknowledged the pay-scale anomaly but said it would be eliminated by April 2009, and upheld the Council’s appeal.
