The Labour Court modified a recommendation on a Senior Dental Nurse promotion appeal by HSE South East, directing it to offer the worker the post on a four-day week. The decision was signed on 11 May 2009. The worker, who placed first in a competition for the post, had been working part time and wanted to return to full-time hours or work four days a week. The union argued that the job had been advertised as full time. HSE South East cited funding and staffing limits. The Court found that the post had been advertised as full time and upheld the Rights Commissioner’s finding and recommendation. It modified the recommendation to require the employer to offer the worker the post on a four-day week, which she had said she was willing to work.
