The Labour Court rejected an unnamed Fás worker’s claim that she was pressured into accepting a lower grade, but recommended that she be placed at point 12 of Grade 11, with retrospective payments from 1 December 1995. The Court’s decision was signed on 6 May 2009. The worker had worked as an instructor in Dublin before transferring to a clerical role in Galway. The Court found that Fás had not exerted undue pressure and upheld its right to regularise the arrangement. It said her overall service should count towards assimilation onto Grade 11 and overturned the Rights Commissioner’s recommendation.
