The Labour Court varied a Rights Commissioner’s recommendation in Mayo County Council’s appeal over disciplinary action against a worker, setting aside the €5,000 compensation recommendation and changing a final written warning to a written warning. The decision was signed on 6 May 2009. The Court found it was inappropriate for the Council to include an allegation the worker had not previously been told about, which contributed to mistrust and his non-cooperation. But it considered a disciplinary sanction appropriate because he admitted he may have misconducted himself and had supervisory responsibility for 30 workers. The Court also declined to recommend negotiations on the Council’s disciplinary procedures, finding they complied with the cited code of practice.
