Labour Court overturns pay-grade recommendation to Castlebar Town Clerk

The Labour Court overturned a Rights Commissioner’s recommendation that Mayo County Council pay a Castlebar Town Clerk at the Senior Executive Officer scale from 28 April 2002. The Court’s decision was dated 27 April 2009. The worker, represented by the Irish Municipal, Public and Civil Trade Union, argued that her duties and Castlebar’s population growth supported the higher grade. The council said she had been appointed as an Administrative Officer and assigned to the Town Clerk position, rather than recruited specifically as a Town Clerk under the relevant agreement. The Court found she had been appointed to Administrative Officer Grade VII and that her position was outside the agreement. It found she was appropriately graded, while recommending that her functions and reporting arrangements be clarified and confirmed.
