The Labour Court dismissed Fingal Home Care Limited’s appeal and upheld a recommendation that it pay a worker sick pay due under the collective agreement for covered periods of certified leave. The decision was signed on 9 January 2009. The Court found Fingal Home Care, which received 80–85% of its funding from the HSE, was a voluntary body covered by the agreement. It concluded that home helps should receive pro-rata sick pay on the terms applying in the Health Service.
