The Labour Court increased a worker’s compensation from €900 to €1,000 after finding that the summary dismissal fell short of good industrial relations practice and fair procedures. The decision was signed on 23 April 2009. Matthew of Clones Ltd said the worker was unsuitable for the Senior Shop Assistant role and that it could end her employment during probation. The worker disputed the employer’s criticism of her performance and said it had not raised concerns before dismissing her. The Court did not consider the dismissal to have been because of pregnancy. It found that incompatibility between the worker and her employer made continued employment difficult, particularly during probation, and varied the recommendation to set compensation at €1,000.
