The Labour Court rejected An Post’s appeal and upheld a Rights Commissioner’s recommendation, including a €1,500 payment to a worker in An Post’s Human Resources Services. The decision was dated 16 March 2009. The dispute concerned changes to HR work practices and sick pay. The worker, represented by the CPSU, said the changes increased his workload and that he lost sick pay after being threatened with disciplinary action over a missing medical certificate. An Post said he left work because he would not cooperate with agreed changes, and that it paid him sick pay throughout his absence. The Rights Commissioner had recommended restoring any sick pay lost and discussing a managed return to work without reducing the worker’s grade or status. The Labour Court said it concurred with the recommendation after considering both sides’ submissions. A separate Payment of Wages Act claim was not decided in the worker’s favour.
