The Labour Court overturned a Rights Commissioner's recommendation that a worker receive a 35-hour week and €3,000 compensation from Trinity College Dublin. The Court rejected the worker's claims for backdated pay, restoration of a 10% allowance and shorter hours, but upheld his appeal against the red-circled basis. Both Trinity College Dublin and the worker appealed. The decision was signed on 6 January 2009. The worker, represented by the Services Industrial Professional Technical Union, sought pay backdated to 1999, reinstatement of the allowance and a 34.6-hour week with retrospective hourly-pay adjustment. The Court found his 2003 regrading placed him on a scale related to Executive Scale 1, and that the allowance had been incorporated into his new salary. It also found his hours were in line with other grades on the analogous scale. The Court accepted that his position was not red-circled.
