The Labour Court upheld Sligo Borough Council’s appeal and overturned a Rights Commissioner’s recommendation that it pay a worker 95% of the craft rate. The Court’s decision was dated 23 December 2008. The Services Industrial Professional Technical Union said the worker performed skilled duties beyond those expected of a general operative. The Council said a weekly €24.19 allowance covered the extra responsibilities. The Court found no entitlement to the differential, noting a 1997 agreement on general operatives undertaking non-core craftwork. It also found the cost-increasing claim was debarred under Towards 2016.
