Labour Court recommends crediting worker’s service with Baldoyle project from 2000

The Labour Court recommended that a worker’s service with Baldoyle Community Employment Project be credited from 16 November 2000 for redundancy purposes, after Anchor Training Limited appealed a Rights Commissioner recommendation. The decision was dated 3 November 2008. The worker’s union, the Services Industrial Professional Technical Union, said her service continued without a break after she transferred to Anchor Training in 2003. The company said she had received a P45 and signed a new contract. The Court found a connection between the two organisations and considered the earlier recommendation’s enhanced redundancy multiplier fair and reasonable. The Court also recommended that the parties cooperate to seek funding for the recommended amount because the employer could not pay it from its own resources.
